Abstract : The purpose of the research is to provide a comparative study on how West Bank Israeli and Palestinian children experience the Israeli detention system. The analysis was done within the legal framework of International Child Rights Law (ICRL), with a specific focus on the Convention of the Rights of the Child. The research findings show the existence of two separate and unequal legal systems in the West Bank; one for Israeli children which operates within the norms of ICRL and the other system, the Israeli military legal system, which systematically and with impunity violates the rights of Palestinian children. Both Israeli and Palestinian children deserve and have the right to equal treatment and protection under International Child Rights Law. The research concludes that the Israeli Military Juvenile Justice system should be abolished and all children in the West Bank should have equal access to a civil justice system which protects and respects their rights. “Humanity owes to the child the best that it has to give”, Geneva Declaration, 1924
